The North Face / Ski Train Competition Terms and Conditions
1. By entering this prize draw, the entrant will be deemed to have read, understood and accepted these Terms and Conditions and agreed to be bound by them.
2. This prize draw is open to all individuals aged 18 years or over resident in the UK, Channel Isles or Isle of Man. Employees of Eurostar Group Limited and Eurostar (U.K.) Limited (together referred to as "Eurostar"), The North Face (“The North Face”) or Ellis Brigham Limited (“Ellis Brigham”), their affiliate companies, their families or agents or anyone associated with this prize draw are not eligible to enter this prize draw.
3. Entrants can enter this prize draw by completing the Eurostar prize draw postcard (“Eurostar Prize Draw Postcard”) and depositing it at any central London Ellis Brigham store.
4. This prize draw is limited to one entry per person. Applications by groups or syndicates are not permitted.
5. Entry to this prize draw is free and no purchase is necessary.
6. There will be five (5) prizes available under this prize draw. Each prize consists of two (2) return tickets in Standard Class on the Eurostar Ski Train service, from St Pancras International Station or Ashford International Terminal to each winner’s choice of Moutiers, Aime-la-Plagne (outbound only) or Bourg-St-Maurice. The Eurostar Ski Train service runs from 19 December 2009 to 17 April 2010. The Eurostar ticket prize is in the form of a voucher and is valid for one (1) year from the date of issue.
7. The prize draw is open from 7am on 1 October 2009 GMT. The closing date for all entries for this prize draw is 11:59pm on 31 October 2009 GMT. All entries must be received before the closing date. Late entries will not be taken into consideration in the selection of each winner.
8. Prizes are not transferable and there is no cash alternative for the prizes. No responsibility will be taken for lost or incomplete entries. Eurostar will send each winner an original booking form to the address provided by each winner on the Eurostar Prize Draw Postcard. The winner must send Eurostar this original booking form before reservations can be confirmed and tickets issued. Photocopies will not be accepted. Eurostar accepts no liability for originals lost in the post.
9. Eurostar and The North Face do not accept any responsibility for the non-receipt or the late receipt, of the Eurostar Prize Draw Postcard or for any associated costs to entrants.
10. The winners will be chosen randomly under independent supervision. The winners will be notified by email or by phone call on or before 5:00pm (GMT) 6 November 2009 with details of how to claim their prize. If any of the initial winners are untraceable after The North Face’s reasonable efforts, then The North Face shall be entitled to select a new winner.
11. The name, age, town or county of the winner will be sent to anyone who writes requesting such information within three (3) months of the closing date, enclosing a stamped addressed envelope to “Eurostar Ski Train Prize Draw”, The North Face, Rivermill, Staveley Mill Yard, Staveley, Kendal, Cumbria, LA8 9LR. Entrants accept that, if they win, Eurostar and The North Face have the right (without any additional payment or permission) to use their name, age, town or county of residence or likeness for the purposes of announcing the winners and for related promotional purposes.
12. Travel on Eurostar Ski Train services is subject to availability. Some dates are not available for travel including, but not limited to, 13 February 2010 to 20 February 2010 (inclusive), 1 April 2010 to 17 April 2010 (inclusive), all Public/Bank Holiday weekends in the UK, France and Belgium, and Valentine’s Day. Eurostar train travel under this prize draw is subject to availability and the levels of availability may change. In this respect, availability for travel using the Eurostar tickets offered in accordance with this prize draw (“Eurostar Tickets”) is limited for each train. Some trains may not be available for travel with the Eurostar Tickets; some trains may already be full and consequently no seats will be available for holders of Eurostar Tickets. This is more likely during holiday periods.
13. All bookings must originate in the United Kingdom. The winner and their chosen companion must travel together on both the outbound and the return journeys on the Eurostar Ski Train.
14. No alterations, exchanges or refunds of the Eurostar tickets will be permitted after the reservation has been made.
15. The prize does not include any other incidentals including, but not limited to, meals, drinks, mini-bars, telephone calls, travel insurance, accommodation and the cost of transportation to and from St Pancras International Station or Ashford International Terminal and at the destination. These are the responsibility of each winner.
16. The prize cannot be used in conjunction with any other offer. Previous bookings made prior to, and for, travel during the validity of this prize cannot be exchanged or refunded for any ticket acquired in accordance with this prize.
17. The winners and their chosen companions must comply with all relevant customs, security and immigration requirements, including appropriate passport and visa requirements. Eurostar will not be responsible for any passenger’s failure to comply with these requirements. The winners are strongly advised to take out adequate levels of travel insurance.
18. The winners and their chosen companions must check in at least thirty (30) minutes before departure on the Eurostar train and may not be allowed to board the train if they do not do so. Eurostar will not be liable for any passengers failing to make the departure time indicated on their tickets.
19. Eurostar shall not be responsible for any indirect, special or consequential damages or losses suffered by the winners, any entrant or a third party.
20. Eurostar and The North Face reserve the right to refuse to honour any entry if they consider there has been an abuse of this prize draw or a breach of these Terms and Conditions.
21. Eurostar and/or The North Face’s decision is final on any situation including any not covered in these Terms and Conditions. Please note that Eurostar and The North Face will not enter into any correspondence concerning any decisions made.
22. Eurostar and/or The North Face may, at any time and for any reason, elect to change or withdraw the prize draw and shall not be liable for any costs, claims, damages or loss occasioned by any such election or by failure, however caused, to fulfil the terms of this prize draw.
23. Eurostar (U.K.) Limited Conditions of Carriage apply to all Eurostar travel, copies of which may be obtained by writing to Eurostar UK Sales, Times House, Bravingtons Walk, London, N1 9AW or via the website: www.eurostar.com.
24. These Terms and Conditions shall be governed by English Law and the exclusive jurisdiction of the English Courts shall apply.
